PolkMarketplace.com (“Site” or “Company”) offers you a wide range of services (“Services”) via this website.  Please review the following terms that govern your use of the Site.  Please be advised that your use of this website constitutes your agreement to follow and be bound by the following Terms and Conditions.

Attention:  This Site and these Terms and Conditions may be changed by PolkMarketplace.com with or without notice.  Please review this link on a regular basis for changes.  Continued use of this website following any change constitutes your acceptance of the change.

Terms and Conditions
PolkMarketplace.com is a division of MJ Innovative Solutions and is an advertising / marketing service.  Our goal is to provide sellers and buyers an opportunity to connect via an internet based system.

The seller or employer is responsible for the accuracy of their listing.  Information submitted by advertisers has not been verified and is subject to change.  We will not be liable for any loss or damage arising from errors in your listing.

You must agree to maintain the information of your listing by promptly modifying it to reflect the most current conditions.

All listings must comply with applicable local, state, and federal laws including housing and employment laws.

User Submissions and Conduct
The Advertiser assumes the liability and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to PolkMarketplace.com for inclusion in listings are owned by the Advertiser, or that the Advertiser has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend PolkMarketplace.com from any claim or suit arising from the use of such elements furnished by the Advertiser.

While using PolkMarketplace.com, you will not:

• Include content that is pornographic, distasteful, illegal, false, inaccurate, misleading, or defamatory.
• Violate any laws, third party rights, or our policies.
• Circumvent or manipulate our fee structure, the billing process, or fees owed to MonkeyListigs.com.
• Transfer your listing(s) to another party without our consent.
• Copy, modify, or distribute content from the Site.
• Harvest or otherwise collect information about users, including email addresses, without their consent.

Termination and Agreement
We reserve the right to review and approve/deny any ad that is placed on PolkMarketplace.com.  If your submitted ad is denied, your listing fee will be refunded.  If your original ad is approved and you change it at a later date that prompts removal, your listing fee will NOT be refunded.

Fees and Services
Registering on PolkMarketplace.com and viewing listings is free.  We do charge fees for using other services, such as listing items and banner advertising.  When you list an item or use a service that has a fee, you have an opportunity to review and accept the fees that you will be charged.  Our fees may change from time to time.  All fees are quoted in U.S. Dollars and are collected via the PayPal payment system.

Since we incur nearly all of our expenses during the first few days of a new listing, we cannot offer refunds.

This website contains links to other sites.  Please be aware that we are not responsible for the content or privacy practices of such other sites.  We encourage our users to be aware when they leave our site and to read the privacy statements of any other site that collects personally identifiable information

Limitation of Liability
You will not hold PolkMarketplace.com responsible for other users’ actions, including things they list.  We are not involved in the actual transaction between buyers and sellers.  We have no control over and do not guarantee the quality, safety or legality of items advertised, or the truth or accuracy of listings.  We cannot guarantee continuous or secure access to our services, and operation of the Site may be interfered with by numerous factors outside of our control.  We are not liable for any loss of money, goodwill, reputation, or any special, indirect, or consequential damages arising out of your use of our Site.  Regardless, if we are found to be liable, our liability to you or to any third party is limited to the lesser of (a) the total listing fee you paid to use for the listing in question,   or (b) $100.

Governing Laws
This Agreement shall be construed and enforced in accordance with the laws of the State of Florida.  Any legal action regarding this agreement shall occur in the venue of Polk County, Florida. 

General
MonkeyListings.com is a division of MJ Innovative Solutions, located at 1420 Maple Street, Lakeland, FL  33810.  If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.  Our failure to act with respect to a breach by you or others does not waive the right to act with respect to subsequent or similar breaches.  We do not guarantee we will take action against all breaches of this Agreement.
